INTRODUCTION / INTRODUCCIÓN

Aqui Coqui LLC and its subsidiaries (collectively, “Aqui Coqui,” “we,” or “us”), provide an online peer-to-peer vehicle sharing platform that connects independent vehicle owners (“Hosts”) with travelers and locals seeking to book those vehicles. Aqui Coqui is accessible online including at aquicoquicarsharing.com and Aqui Coqui’s Facebook page and associated services (collectively, the “Services”). By accessing or using the Services, including by communicating with us or other Aqui Coqui users, you agree to comply with and be legally bound by this Agreement.

These Terms, together with Aqui Coqui’s Privacy Policy, applicable insurance terms and certificates, roadside assistance terms, and the user policies incorporated by reference, constitute the complete “Agreement” between you and Aqui Coqui.

ESPAÑOL
Aqui Coqui LLC y sus subsidiarias (colectivamente, “Aqui Coqui”, “nosotros” o “nuestro”) proveen una plataforma en línea de alquiler/uso compartido de vehículos entre particulares (peer-to-peer) que conecta propietarios independientes (“Anfitriones”) con viajeros y residentes que desean reservar dichos vehículos. Aqui Coqui está disponible en aquicoquicarsharing.com y en la página de Facebook de Aqui Coqui, además de servicios asociados (colectivamente, los “Servicios”). Al acceder o utilizar los Servicios, incluyendo comunicarse con nosotros o con otros usuarios, usted acepta cumplir y quedar legalmente obligado por este Acuerdo.

Estos Términos, junto con la Política de Privacidad, términos/certificados aplicables de protección/seguro, términos de asistencia en carretera y políticas incorporadas por referencia, constituyen el “Acuerdo” completo entre usted y Aqui Coqui.

MODIFICATION / MODIFICACIONES

ENGLISH
Aqui Coqui reserves the right, at our sole discretion, to modify the Services or this Agreement at any time by updating the “Last Revised” date. Continued use after notice constitutes acceptance. If unacceptable, your sole recourse is to stop using the Services.

Aqui Coqui se reserva el derecho, a su sola discreción, de modificar los Servicios o este Acuerdo en cualquier momento actualizando la fecha de “Última Revisión”. El uso continuo después de la notificación constituye aceptación. Si no está de acuerdo, su único recurso es dejar de utilizar los Servicios.

1. Parties and Nature of Agreement

ENGLISH
This Rental Agreement (“Agreement”) is entered into between the individual completing the booking (“Renter,” including any Approved Additional Driver) and Aqui Coqui LLC (“Aqui Coqui”). Aqui Coqui operates a peer-to-peer vehicle sharing platform connecting independent vehicle owners (“Hosts”) with renters. Aqui Coqui does not own most vehicles listed on the platform. By booking, paying for, or taking possession of a vehicle, the Renter agrees to be legally bound by this Agreement.

Este Contrato de Alquiler (“Acuerdo”) se celebra entre la persona que completa la reservación (“Arrendatario”, incluyendo cualquier Conductor Adicional Aprobado) y Aqui Coqui LLC (“Aqui Coqui”). Aqui Coqui opera una plataforma peer-to-peer que conecta propietarios independientes (“Anfitriones”) con arrendatarios. Aqui Coqui no es dueño de la mayoría de los vehículos publicados. Al reservar, pagar o tomar posesión del vehículo, el Arrendatario acepta quedar legalmente obligado por este Acuerdo.

2. Peer-to-Peer Structure and No Agency

ENGLISH
Aqui Coqui is not a traditional rental car company. Vehicle ownership remains with the Host at all times. Nothing in this Agreement transfers ownership or any proprietary interest in the vehicle to the Renter. Nothing in this Agreement creates a partnership, joint venture, employer-employee relationship, or agency relationship between Aqui Coqui and any Host.

Aqui Coqui no es una compañía tradicional de alquiler de autos. La titularidad del vehículo permanece en todo momento con el Anfitrión. Nada en este Acuerdo transfiere propiedad o interés propietario alguno al Arrendatario. Nada en este Acuerdo crea una relación de sociedad, empresa conjunta, empleo o agencia entre Aqui Coqui y cualquier Anfitrión.

3. Eligibility

ENGLISH
Renter must:
• Be at least 18 years old, or such higher minimum age as required by vehicle listing or platform policy at the time of booking;
• Possess a valid driver’s license;
• Present valid government-issued identification;
• Meet platform verification standards.

3.1 Young Driver Fee

Renters between the ages of 18 and 24 (inclusive) are subject to a Young Driver Fee of $25 per rental day unless otherwise specified at booking.
International drivers must provide a valid driver’s license and International Driving Permit (IDP) where applicable.

El Arrendatario debe:
• Tener al menos 18 años, o la edad mínima superior requerida por el anuncio del vehículo o la política de la plataforma al momento de reservar;
• Poseer licencia de conducir válida;
• Presentar identificación oficial válida;
• Cumplir con los estándares de verificación de la plataforma.

3.1 Cargo por Conductor Joven

Arrendatarios entre 18 y 24 años (inclusive) estarán sujetos a un Cargo por Conductor Joven de $25 por día, salvo que se indique lo contrario al reservar.
Conductores internacionales deben presentar licencia válida y Permiso Internacional de Conducir (IDP) cuando aplique.

4. Insurance and Financial Responsibility

4.1 Not an Insurance Provider / 4.1 No Somos Aseguradora

ENGLISH
Aqui Coqui LLC is not an insurance company and does not provide automobile liability insurance, collision insurance, or underwrite insurance products. Any protection option offered through the platform is a contractual risk allocation mechanism and not an insurance policy. Hosts are responsible for maintaining legally required insurance under Puerto Rico law.

Aqui Coqui LLC no es una compañía de seguros y no provee seguro de responsabilidad civil, colisión, ni suscribe productos de seguro. Cualquier opción de protección ofrecida es un mecanismo contractual de asignación de riesgo y no una póliza de seguro. Los Anfitriones son responsables de mantener el seguro requerido por la ley de Puerto Rico.

4.2 Third-Party Liability and AXEL Verification / 4.2 Responsabilidad a Terceros y Verificación AXEL

ENGLISH
The Renter is solely responsible for ensuring that their personal automobile insurance extends coverage to vehicles rented or booked through peer-to-peer car sharing platforms. Aqui Coqui may utilize third-party insurance verification services, including but not limited to AXEL, to facilitate review of insurance information submitted by the Renter.

Verification:
• Confirms that documentation was submitted and reviewed at the time of booking;
• Does not constitute approval or guarantee of coverage;
• Does not create insurance coverage;
• Does not transfer liability to Aqui Coqui;
• Does not obligate Aqui Coqui to defend or pay any claim.

The Renter acknowledges that the ultimate determination of coverage rests solely with the insurance carrier. Regardless of insurance verification status or whether coverage applies, the Renter remains fully and personally responsible for:
• Bodily injury to third parties
• Damage to other vehicles
• Property damage
• Civil liability claims
• Settlements, judgments, attorney fees, and related costs
• Traffic citations, tolls, and penalties

Aqui Coqui assumes no responsibility for third-party liability claims.

El Arrendatario es el único responsable de asegurar que su póliza personal extienda cobertura a vehículos reservados mediante plataformas de car sharing peer-to-peer. Aqui Coqui puede utilizar servicios de verificación de seguro de terceros, incluyendo pero sin limitarse a AXEL, para facilitar la revisión de la información de seguro provista por el Arrendatario.

La verificación:
• Confirma que la documentación fue sometida y revisada al reservar;
• No constituye aprobación ni garantía de cobertura;
• No crea cobertura de seguro;
• No transfiere responsabilidad a Aqui Coqui;
• No obliga a Aqui Coqui a defender o pagar reclamaciones.

El Arrendatario reconoce que la determinación final de cobertura corresponde únicamente a la aseguradora. Independientemente del estatus de verificación o si aplica cobertura, el Arrendatario seguirá siendo total y personalmente responsable por:
• Lesiones corporales a terceros
• Daños a otros vehículos
• Daños a propiedad
• Reclamaciones de responsabilidad civil
• Acuerdos, sentencias, honorarios legales y costos relacionados
• Multas, peajes y penalidades

Aqui Coqui no asume responsabilidad por reclamaciones de terceros.

4.3 Rental Protection Plan / 4.3 Plan de Protección de Alquiler (Solo Daño al Vehículo Reservado)

ENGLISH
If selected, the Rental Protection Plan:
• Covers direct physical damage to the booked vehicle only
• Maximum limit: $35,000
• Deductible: $500 per incident
• Applies only during confirmed reservation period

The Protection Plan does NOT cover:
• Third-party bodily injury
• Third-party property damage
• Civil liability claims
• Unauthorized drivers
• Driving under the influence
• Intentional acts
• Gross negligence
• Commercial misuse
• Mechanical failure not caused by collision

If total damages exceed $35,000, the Renter remains responsible for all additional amounts.

ESPAÑOL
Si se selecciona, el Plan de Protección de Alquiler:
• Cubre únicamente daño físico directo al vehículo reservado
• Límite máximo: $35,000
• Deducible: $500 por incidente
• Aplica solo durante el periodo confirmado de reservación

NO cubre:
• Lesiones corporales a terceros
• Daños a propiedad de terceros
• Reclamaciones de responsabilidad civil
• Conductores no autorizados
• Conducir bajo la influencia
• Actos intencionales
• Negligencia grave
• Uso comercial
• Fallas mecánicas no causadas por colisión

Si los daños exceden $35,000, el Arrendatario será responsable por cualquier exceso.

4.4 Insurance or Protection Requirement / 4.4 Requisito de Seguro o Protección

ENGLISH
Renter must either:

1. Provide valid proof of      personal insurance (verified through AXEL or other designated system); OR
2. Select the Rental Protection      Plan.
       Failure to provide verifiable proof of insurance when requested may result      in denial of booking or mandatory selection of the Rental Protection Plan.

El Arrendatario debe:

1. Proveer      evidencia válida de seguro personal (verificada mediante AXEL u otro      sistema designado); O
2. Seleccionar      el Plan de Protección de Alquiler.
       No proveer evidencia verificable cuando se solicite puede resultar en      denegación de la reservación o selección obligatoria del Plan de      Protección.

4.5 Claims & Reporting / 4.5 Reclamaciones y Reportes

ENGLISH
• All incidents must be reported within 24 hours.
• Police report required where legally applicable.
• Claims must be submitted within 30 days of the incident or trip end date if unknown.

Late penalties:
• $500 administrative fee after 30 days
• $30 per day thereafter
• Security deposit may be held

ESPAÑOL
• Todo incidente debe reportarse dentro de 24 horas.
• Se requiere informe de la policía cuando aplique legalmente.
• Las reclamaciones deben someterse dentro de 30 días del incidente o, si la fecha es desconocida, dentro de 30 días del fin del viaje.

Penalidades por tardanza:
• $500 de cargo administrativo después de 30 días
• $30 por día adicional
• El depósito de seguridad puede retenerse

5. Assumption of Risk

ENGLISH
Renter acknowledges that operating a motor vehicle involves inherent risks of accident, injury, property damage, and death. Renter voluntarily assumes all risks associated with the use, operation, and possession of the vehicle.

El Arrendatario reconoce que operar un vehículo conlleva riesgos inherentes de accidente, lesiones, daños a propiedad y muerte. El Arrendatario asume voluntariamente todos los riesgos asociados al uso, operación y posesión del vehículo.

6. Vehicle Use Restrictions

6. Restricciones de Uso del Vehículo

ENGLISH
Renter agrees:
• Personal use only
• No Uber, Lyft, delivery, or commercial use
• No racing or off-roading
• No illegal activity
• No impaired driving
• Return vehicle on time and in similar condition
Violation may void protection benefits.

ESPAÑOL
El Arrendatario acepta:
• Uso personal únicamente
• No Uber, Lyft, delivery ni uso comercial
• No carreras ni uso fuera de carretera
• No actividad ilegal
• No conducir bajo influencia
• Devolver a tiempo y en condición similar
La violación puede anular beneficios de protección.

7. Vehicle Inspection

7. Inspección del Vehículo

ENGLISH
Renter must inspect vehicle before departure. Failure to report pre-existing damage before departure creates presumption that damage occurred during rental.

El Arrendatario debe inspeccionar el vehículo antes de salir. No reportar daños preexistentes antes de la salida crea la presunción de que el daño ocurrió durante el alquiler.

8. Security Deposit

ENGLISH

• Standard: $250

• With Protection Plan: $150

• Young Drivers (Ages 18–24): $350 security deposit, regardless of Protection Plan selection

• Refund processed after inspection (up to 15 business days).

• Conductores Jóvenes (18–24 años): depósito de seguridad de $350, independientemente de si seleccionan el Plan de Protección

9. Fees and Charges

ENGLISH
Charges may be applied up to one (1) year after rental due to delayed tolls or citations. Examples include:
• Lost key: $200 ($500 smart key)
• Smoking violation: $250
• Excessive cleaning: minimum $150
• Towing: minimum $350
• Unauthorized toll use: $60 admin + daily charges
• Tire blowout: $250
• Late extension fee: $30
• Out-of-Service Fee: daily rental rate × repair days
Failure to respond to charges within a reasonable time may be deemed acceptance.

ESPAÑOL
Los cargos pueden aplicarse hasta un (1) año después debido a peajes o multas retrasadas. Ejemplos:
• Llave perdida: $200 ($500 llave inteligente)
• Violación por fumar: $250
• Limpieza excesiva: mínimo $150
• Remolque: mínimo $350
• Uso no autorizado de peajes: $60 admin + cargos diarios
• Explosión de goma: $250
• Cargo por extensión tardía: $30
• Cargo por Fuera de Servicio: tarifa diaria × días de reparación
No responder a cargos dentro de un tiempo razonable puede considerarse aceptación.

10. Vehicle Tracking

ENGLISH
Vehicles may contain GPS or tracking devices. Tampering, disabling, or removing tracking devices results in:
• $1,500 penalty
• Replacement costs
• Potential termination of rental

Los vehículos pueden contener GPS o dispositivos de rastreo. Manipular, desactivar o remover estos dispositivos resulta en:
• Penalidad de $1,500
• Costos de reemplazo
• Posible terminación del alquiler

11. Theft & Repossession

11. Hurto y Recuperación

ENGLISH
Failure to return vehicle within 12 hours of scheduled return without approved extension may result in vehicle being reported stolen. Vehicle may also be reported stolen if:
• Not returned to authorized location
• False information provided
• Left unlocked with keys
Administrative theft fee: $1,000 + recovery costs. Aqui Coqui or Host may repossess vehicle without notice at Renter’s expense.

ESPAÑOL
No devolver el vehículo dentro de 12 horas de la hora programada, sin extensión aprobada, puede resultar en que el vehículo sea reportado como robado. También puede reportarse como robado si:
• Se devuelve a una ubicación no autorizada
• Se provee información falsa
• Se deja abierto con llaves
Cargo administrativo por hurto: $1,000 + costos de recuperación. Aqui Coqui o el Anfitrión pueden recuperar el vehículo sin previo aviso a costo del Arrendatario.

12. Out-of-Service & Diminished Value

ENGLISH
If damage renders vehicle unrentable, Renter owes:
• Repair costs
• Daily rental rate × repair days
• Towing
• Administrative costs
• Diminished value (if applicable)

Si el daño hace que el vehículo no pueda alquilarse, el Arrendatario adeuda:
• Costos de reparación
• Tarifa diaria × días de reparación
• Remolque
• Costos administrativos
• Valor disminuido (si aplica)

13. Indemnification

ENGLISH
Renter agrees to indemnify and hold harmless Aqui Coqui, its officers, employees, agents, and Hosts from any claims, losses, damages, attorney fees arising from:
• Use of vehicle
• Violation of this Agreement
• Third-party injury or damage

ESPAÑOL
El Arrendatario acepta indemnizar y mantener indemne a Aqui Coqui, sus oficiales, empleados, agentes y Anfitriones por reclamaciones, pérdidas, daños y honorarios legales que surjan de:
• Uso del vehículo
• Violación de este Acuerdo
• Lesiones o daños a terceros

14. Limitation of Liability

14. Limitación de Responsabilidad

ENGLISH
Aqui Coqui’s maximum liability shall not exceed the greater of:
• $100; or
• Amount paid by Renter in the previous 12 months.
Aqui Coqui is not liable for indirect, incidental, special, or consequential damages.

La responsabilidad máxima de Aqui Coqui no excederá el mayor de:
• $100; o
• La cantidad pagada por el Arrendatario en los últimos 12 meses.
Aqui Coqui no será responsable por daños indirectos, incidentales, especiales o consecuenciales.

15. Liquidated Damages

ENGLISH
Circumventing the platform or fraudulent misuse results in $5,500 per incident as liquidated damages, to the extent permitted by Puerto Rico law. Court may reduce amount if deemed excessive.

Eludir la plataforma o uso fraudulento conlleva $5,500 por incidente como daños liquidados, según lo permita la ley de Puerto Rico. Un tribunal podrá reducir la cantidad si se considera excesiva.

16. Force Majeure

ENGLISH
Aqui Coqui shall not be liable for delays, cancellations, or inability to perform due to acts of God, hurricanes, storms, natural disasters, government action, power outages, labor disruptions, or events beyond reasonable control.

ESPAÑOL
Aqui Coqui no será responsable por retrasos, cancelaciones o imposibilidad de cumplimiento debido a caso fortuito o fuerza mayor, incluyendo huracanes, tormentas, desastres naturales, acciones gubernamentales, apagones, interrupciones laborales o eventos fuera de control razonable.

17. Dispute Resolution & Arbitration

ENGLISH
Disputes are subject to binding arbitration under the Federal Arbitration Act. Puerto Rico substantive law applies. Opt-out permitted within 30 days via email to: customerservice@aquicoquicarsharing.com. Class and representative actions are waived.

ESPAÑOL
Las disputas se someterán a arbitraje vinculante bajo la Ley Federal de Arbitraje. Aplica la ley sustantiva de Puerto Rico. Puede excluirse dentro de 30 días escribiendo a: customerservice@aquicoquicarsharing.com. Se renuncia a acciones colectivas y representativas.

18. Governing Law & Venue

ENGLISH
Puerto Rico law governs this Agreement. Non-arbitrable disputes must be filed in San Juan, Puerto Rico.

Este Acuerdo se rige por las leyes de Puerto Rico. Disputas no arbitrables deberán radicarse en San Juan, Puerto Rico.

19. Entire Agreement & No Waiver

ENGLISH
This Agreement constitutes the entire understanding between the Parties and supersedes prior agreements. Failure by Aqui Coqui to enforce any provision shall not constitute waiver of future enforcement. If any provision is unenforceable, the remainder remains in effect.

Este Acuerdo constituye el entendimiento completo entre las Partes y sustituye acuerdos previos. El hecho de que Aqui Coqui no haga valer alguna disposición no constituye renuncia a su cumplimiento futuro. Si alguna disposición fuera inexigible, el resto permanecerá vigente.

20. Electronic Contract Formation and Digital Acceptance

20.1 Electronic Execution / 20.1 Ejecución Electrónica

ENGLISH
By clicking “Book Now,” “Confirm Reservation,” “Reserve,” “Pay,” “Complete Booking,” or similar action, the Renter:
• Confirms they have read and understood this Agreement;
• Agrees to be legally bound;
• Acknowledges this is a binding legal contract;
• Consents to transact business electronically;
• Agrees electronic acceptance is a valid electronic signature.
Executed pursuant to the U.S. E-SIGN Act and applicable Puerto Rico law.

ESPAÑOL
Al hacer clic en “Book Now/Reservar”, “Confirm Reservation/Confirmar”, “Reserve/Reservar”, “Pay/Pagar”, “Complete Booking/Completar”, o acción similar, el Arrendatario:
• Confirma que leyó y entendió este Acuerdo;
• Acepta quedar legalmente obligado;
• Reconoce que es un contrato legal vinculante;
• Consiente a transacciones electrónicas;
• Acepta que la aceptación electrónica constituye firma válida.
Se ejecuta conforme a la Ley E-SIGN y la ley aplicable de Puerto Rico.

20.2 Affirmative Acceptance / 20.2 Aceptación Afirmativa

ENGLISH
Acceptance requires an affirmative action, including:
• Selecting a checkbox (if presented);
• Clicking “Book Now,” “Confirm,” “Reserve,” “Pay,” or similar;
• Completing payment through Stripe or an authorized processor.
Completing booking constitutes voluntary acceptance even without a physical signature. Failure to read does not invalidate acceptance.

ESPAÑOL
La aceptación requiere una acción afirmativa, incluyendo:
• Marcar una casilla de aceptación (si se presenta);
• Hacer clic en “Reservar/Confirmar/Pagar” o similar;
• Completar pago mediante Stripe u otro procesador autorizado.
Completar la reservación constituye aceptación voluntaria aunque no haya firma física. No leer no invalida la aceptación.

20.3 Accessibility / 20.3 Accesibilidad

ENGLISH
This Agreement is available for review before payment via hyperlink/portal/checkout. Renter has opportunity to download/print/retain a copy. Electronic version controls.

Este Acuerdo está disponible para revisión antes del pago mediante enlace/portal/checkout. El Arrendatario tiene oportunidad de descargar/imprimir/guardar una copia. La versión electrónica será la oficial y controladora.

20.4 Authorization to Charge / 20.4 Autorización de Cargos

Renter authorizes Aqui Coqui to:
• Charge rental costs;
• Charge security deposits;
• Charge tolls, citations, damages, out-of-service fees, administrative fees, penalties, and other lawful charges;
• Store payment credentials for lawful future charges;
• Process charges up to one (1) year after rental for delayed tolls/citations/verified damages/outstanding balances.
Improper chargebacks may constitute material breach and may result in fees, collections, and suspension.

21. Third-Party Shuttle Service Release of Liability

Aqui Coqui may, for the convenience of users, provide information regarding third-party shuttle services operated by a separate provider (the “Service Provider”). The operation, management, and provision of shuttle services are solely the responsibility of the Service Provider. Aqui Coqui does not operate, control, or supervise the shuttle services.

21.2 Acknowledgment of Risks

By opting to use the shuttle services provided by the Service Provider, you (“Participant”) acknowledge and accept the risks associated with transportation services, which may include, but are not limited to, personal injury, property damage, and other risks. Participation is voluntary and undertaken at your own risk.

21.3 Release of Liability

Participant agrees to release Aqui Coqui, including its directors, officers, employees, agents, and representatives, from any claims, liabilities, damages, losses, costs, and expenses, including attorney’s fees, arising from or related to any injury, disability, death, or property damage occurring during the use of shuttle services provided by the Service Provider, whether arising from negligence of Aqui Coqui or otherwise, to the maximum extent permitted by law.

You agree to release, defend, indemnify, and hold harmless Aqui Coqui and its subsidiaries, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal and accounting fees, arising out of or connected with: (1) your access to or use of the Services, (2) your violation of the Agreement, (3) your user content, (4) your interaction with any other user, or (5) your booking of a vehicle or creation of a listing. This includes any injuries, losses, or damages (direct, incidental, consequential, or otherwise) arising in connection with a booking, sharing, or use of a vehicle or optional Extra, to the maximum extent permitted by law.

23. Expanded Liquidated Damages Statement

You acknowledge actual damages from certain breaches are difficult to estimate and prove, including but not limited to: (1) gray-market/off-platform transactions, (2) unauthorized use of Aqui Coqui domains, trademarks, taglines, social media handles, or advertising keywords, (3) asserting claims in a manner prohibited or waived by this Agreement, (4) as a host, sharing a vehicle with expired registration or without current registration documents in the vehicle, (5) as a host, offering a vehicle subject to a missing or stolen vehicle report, or (6) creating or using an account to circumvent suspension, termination, or closure of another account. For each such breach, you agree to pay Aqui Coqui $5,500 as liquidated damages (not a penalty), to the extent permitted by law. If a court deems the amount unenforceable or excessive, it may be reduced to the maximum enforceable amount. This provision is a fundamental basis of the bargain.

24. Not a Rental Car Company

Aqui Coqui is not a rental car company. Aqui Coqui does not own a fleet of vehicles and is not in the business of renting vehicles to the public as a traditional rental company. Aqui Coqui provides an online platform where independent vehicle owners and renters can connect and share vehicles subject to this Agreement.

25. Not an Insurance Company; Third-Party Coverage (RentalCover)

ENGLISH
Aqui Coqui is not an insurance provider and does not sell or underwrite insurance. However, Aqui Coqui may accept third-party protection products or coverage obtained by the Renter (for example, RentalCover.com), subject to verification requirements and the terms of such third-party coverage. To use a third-party coverage product, the Renter must: (1) purchase it prior to the rental period, (2) provide proof showing the coverage details and dates aligned with the rental, and (3) present proof at pickup or as otherwise required by Aqui Coqui. The Renter remains responsible for any damages or liabilities not covered or exceeding coverage limits.

Aqui Coqui no es un proveedor de seguros y no vende ni suscribe pólizas. Sin embargo, Aqui Coqui puede aceptar productos de protección o cobertura obtenidos por el Arrendatario (por ejemplo, RentalCover.com), sujeto a verificación y a los términos de dicha cobertura de terceros. 30. Severability, Non-Waiver, Privacy/Marketing Consent, and General Provisions

If any provision is held void, voidable, or unenforceable, the remaining provisions remain in effect. Failure to enforce any provision does not constitute a waiver of that provision or any other provision, and no waiver of one breach is a waiver of another breach.

You are not authorized to make commitments on behalf of Aqui Coqui, and Aqui Coqui will not make commitments on your behalf except as expressly stated in this Agreement or through the Services.

You may discontinue your use of the Services at any time. Aqui Coqui may terminate your access to the Services and remove any listings for any reason or no reason, to the extent permissible under applicable law. Termination of access to the Services will not release a Party from any obligations incurred prior to termination and Aqui Coqui may retain and continue to use any information, including but not limited to photography, previously provided by you. Termination of the Agreement will not affect the disclaimers, waivers, limitation of liability, dispute resolution provisions, and/or any fees due, and all such terms will survive termination.

Except as otherwise provided herein, guests and hosts agree that nothing in these Terms constitutes an actual or purported transfer or assignment of any right or interest in a vehicle or optional Extras shared through the Services.

Aqui Coqui provides an online platform that enables independent Hosts and Renters to connect and share vehicles and optional Extras. Except as expressly stated in this Agreement, Aqui Coqui does not itself provide vehicle rental services, transportation services, mechanical services, maintenance services, insurance services, or vehicle storage services. Aqui Coqui is not responsible for the acts, omissions, errors, representations, warranties, or conduct of any Host, Renter, passenger, additional driver, or third-party service provider.

B. No Endorsement or Guarantee.

Aqui Coqui does not endorse, guarantee, certify, inspect, or warrant any vehicle, Host, Renter, listing, or optional Extra. Aqui Coqui makes no representation regarding:

The safety, roadworthiness, legality, condition, or suitability of any vehicle;

The identity, driving ability, background, or conduct of any user;

The accuracy, completeness, or reliability of any listing, review, rating, photograph, or description;

The availability, timing, or performance of any vehicle or service.

Any reliance on information obtained through the Services is at your own risk.

C. Third-Party Services and Systems.

Vehicles or platform operations may involve third-party services or technologies, including but not limited to GPS systems, telematics, toll systems, payment processors, roadside assistance providers, shuttle operators, insurance verification services (e.g., AXEL), or background check providers. Aqui Coqui is not responsible for any failure, interruption, inaccuracy, delay, malfunction, or act or omission of any such third party.

D. “AS IS” and No Warranties.

THE SERVICES, PLATFORM, CONTENT, LISTINGS, VEHICLES, AND OPTIONAL EXTRAS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AQUI COQUI EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY;

FITNESS FOR A PARTICULAR PURPOSE;

QUIET ENJOYMENT;

NON-INFRINGEMENT;

TITLE;

WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Aqui Coqui does not warrant that:

The Services will be uninterrupted, secure, or error-free;

Defects will be corrected;

The platform will be free of viruses or harmful components;

Any booking will proceed without dispute or interruption.

No oral or written advice, statement, or information obtained from Aqui Coqui or through the Services shall create any warranty not expressly stated in this Agreement.

E. Assumption of Platform Risk.

You acknowledge that participation in a peer-to-peer vehicle sharing marketplace involves inherent risks, including risks arising from interactions with strangers, vehicle condition variability, and third-party conduct. You voluntarily assume such risks to the fullest extent permitted by law.
